Garage Sales

Garage, yard, shed or other type sales are allowed in residential zoning districts with the proper Zoning permits. Sales are limited to 2 per year.
Duration and Frequency

ORANGE COUNTY CODE SECTION 25-28

It shall be a violation of this article for garage sales to extend more than forty-eight (48) hours or to be conducted more than once every six (6) months on any single lot, parcel, or tract of land.

Permit Required; Period

ORANGE COUNTY CODE SECTION 25-29

It shall be a violation of this article for any person to conduct a garage sale on any lot, parcel, or tract of land without first obtaining a permit therefore from the zoning department which permit shall set forth the time and place of such garage sale. Such permit may be obtained by requesting same in writing from the department. Such permit shall be valid for a maximum period of seventy-two (72) hours. The permit provided for herein shall be displayed on the premises at which the sale is being conducted and the board of county commissioners may charge such fee for issuance of such permit as it may deem necessary to cover the cost thereof.

Display of Items Outside; Concealment of Items After Sale

ORANGE COUNTY CODE SECTION 25-30

It shall be a violation of this article for any person during a garage sale to display outside the house, garage, or carport any articles or items for sale except that which might be normally located in such an area such as lawn or yard furniture. At the conclusion of such sales, all unsold articles and items shall be removed or packed in such a manner so as not to be visible from any public street or abutting properties.

Signs or Posters

ORANGE COUNTY CODE SECTION 25-31

Any person holding a garage sale shall be permitted to display only one (1) advertising sign or poster, not to exceed four (4) square feet in area, which sign or poster shall not be placed on any public right-of-way (see temporary directional signs) and shall be removed from the premises of such sale immediately at the conclusion of such sale.

Controlling Parking

ORANGE COUNTY CODE SECTION 25-32

The person conducting the garage sale shall provide for the controlling of parking of vehicles so as not to create a hazard or unsafe condition or any congestion on public streets adjacent to the premises upon which the sale is being conducted.

Refusal to Issue or Revocation of Permit

ORANGE COUNTY CODE SECTION 25-33

If the board of county commissioners or any of its agencies, departments, or divisions shall determine that the items and articles to be sold or the premises at which they are to be sold would adversely affect the public health, safety and welfare, it may refuse to issue the permit provided for herein, or revoke such permit if previously issued.
