The Nuisance Abatement Board (NAB) is a quasi-judicial board consisting of (9 members). The members of the NAB are appointed by the Board of County Commissioners (BCC). The OSCO presents violations to the NAB.
The NAB shall have jurisdiction to hear and decide complaints alleging that a place or premises constitutes a public nuisance and has jurisdiction for a period of one (1) year over any place or premises that has been declared a public nuisance.
A nuisance is described as any place or premises that is alleged to have been used on more than two (2) occasions, within a six (6) month period:
- by a criminal street gang for the purpose of conducting a pattern of criminal street gang activity,
- as the site of a violation of Section 796.07, Florida Statutes, that pertains to prostitution,
- as the site of the unlawful sale, delivery, manufacture or cultivation of any controlled substance,
- as the site on at least one (1) occasion, of unlawful possession of a controlled substance constituting a felony, when it was previously used on more than one (1) occasion
- as the site of the unlawful sale, delivery, manufacture or cultivation of any controlled substance.
- as the site of a violation of (fill in) for dealing in stolen property (this was recently added in the 2000 Legislative amendments)
Public hearings are scheduled for specific dates and times. Typically, NAB hearings are held on the fourth (4th) Thursday of each month, beginning at 9:00 a.m. Notification is given as required by law. Public hearings are held in the Commission Chambers on the 1st floor of the Orange County Administration Center, 201 South Rosalind Avenue, Orlando, Florida 32802. |
